Who this applies to
This page is for creators whose profiles, content, or account details appear in the MySocialGear Creator Console. Many creators appear in the Console without having signed up with us — their public profile information was gathered from public sources and specialist data providers so that brands can discover them. Whether or not you have an account, the rights on this page apply to you.
This page sits alongside our Privacy Notice, which covers everyone who uses our Services. The exact rights available to you depend on where you live and which law applies; we honour the rights below to the extent required by the privacy law that governs your relationship with us.
How your information came to be here, and why
Most creator profiles in the Console are built from publicly available information — for example, public profile details, follower counts, public posts and engagement metrics — collected directly from platforms and through specialist data providers. We combine this with our own analysis (such as estimated category, niche, and engagement rate) to help brands find relevant creators.
Where the law requires a legal basis, we rely on our legitimate interests in operating a creator-discovery service, balanced against your rights and expectations. Because we did not collect this information from you directly, you have a particular right to object to this processing (see Section 1), and where we cannot show an overriding legitimate ground, we will stop and remove your profile.
We hold identity and public performance data for discovery. We do not publish your private contact details to brands — outreach is routed through MySocialGear so your email and phone number are not exposed.
1. The rights you can exercise
| Right | What it means |
|---|---|
| Access | Ask for a copy of the personal information we hold about you and how we use it, including the sources it came from. |
| Correction | Ask us to fix information that is inaccurate, outdated, or incomplete. |
| Deletion / removal | Ask us to delete your personal information and remove your profile from the Console, subject to legal and operational exceptions. |
| Object to our use | Because we gathered your data from public sources under legitimate interests, you can object to us processing it. Where required, we will stop and remove your profile. |
| Portability | Receive certain information in a portable, machine-readable format. |
| Opt out of sale / sharing | Opt out of the sale or sharing of your information for cross-context behavioural advertising, where applicable law provides this right. |
| Withdraw consent | Where we relied on your consent for a specific use, withdraw it at any time — without affecting processing already carried out. |
| Restrict | Ask us to pause certain processing while a question about your data is resolved. |
| Grievance / complaint | Raise a grievance with us or lodge a complaint with your data protection authority. |
2. How to make a request
You do not need an account to exercise your rights. Choose whichever route is easiest:
- By email (no account needed). Email creators@mysocialgear.com and tell us which right you'd like to exercise. This is the primary route for creators who were listed without signing up.
- From the Creator Console. If you have an account, sign in and open Settings → Privacy & Data to request access, correction, or deletion directly against your profile.
- We verify it's you. To protect you, we may ask you to confirm details that match our records — for example, control of the public profile in question — before we act.
- We respond. We reply within the timeframe required by your local law. If we need more time or can't fully act on a request, we'll explain why.
Authorised agents. In some regions you may use an authorised agent to make a request on your behalf. We may ask the agent for proof of authorisation and may still verify your identity directly.
3. Opting out of sale & sharing
Where applicable law gives you this right, you can opt out of the sale or sharing of your personal information for cross-context behavioural advertising. What counts as a sale or sharing, and whether this right applies, depends on your region and the law that governs your data.
We honour the Global Privacy Control (GPC) browser signal as a valid opt-out where applicable law recognises it. You can also opt out at any time through our Do Not Sell or Share My Personal Information page.
4. Regional specifics
India — Digital Personal Data Protection Act, 2023
You may access, correct, and erase your personal data, nominate another individual to exercise your rights, and raise a grievance with us. If unresolved, you may approach the Data Protection Board of India.
United States — CCPA/CPRA and other state laws
Residents of California and other states with comprehensive privacy laws may access, delete, correct, and port their information, and opt out of the sale/sharing of personal information and of targeted advertising. We will not discriminate against you for exercising these rights.
United Kingdom — UK GDPR
You have rights of access, rectification, erasure, restriction, portability, and objection. Because we obtained your information from sources other than you, you also have the right to be told what we hold and where it came from. You may complain to the Information Commissioner's Office (ICO).
Canada — PIPEDA
You may access and correct your personal information and challenge our handling of it. You may also complain to the Office of the Privacy Commissioner of Canada.
United Arab Emirates — Federal Decree-Law No. 45 of 2021 (PDPL)
You may request access, correction, deletion, and portability, restrict or object to processing, and withdraw consent, subject to the conditions in the PDPL.
5. Limits and exceptions
We can't always act on every request. We may decline or limit a request where the law allows or requires it — for example, to keep records we're legally required to hold, to detect fraud or protect security, or to protect the rights of others. When we can't fully act on a request, we'll tell you why.
