This Privacy Notice explains how Social Gear, Inc., a Delaware corporation ("Social Gear," "we," "our," or "us"), collects, uses, stores, shares, and protects personal information when you access or use our advertising platform, websites, applications, dashboards, APIs, and related services (collectively, the "Services"). It applies to advertisers, agencies, brand representatives, creators listed in or contacted through our Creator Console, website visitors, and other users of the Services.

Scope of our Services

The Social Gear Programmatic Console and Creator Console are offered globally. The LYKSTAGE Ad Manager — through which advertisers may purchase advertising inventory on the LYKSTAGE streaming platform — is offered only in the markets where LYKSTAGE is live: the United States, United Kingdom, Canada, United Arab Emirates, and India. LYKSTAGE is operated by LYK Inc. (a separate Delaware corporation, 913 N. Market Street, Suite 300, Wilmington, DE 19801), which provides LYKSTAGE inventory and the connecting API to Social Gear under a commercial arrangement — in the same way other advertising platforms provide inventory and APIs to us. The LYKSTAGE platform and its own users are governed by LYK Inc.'s Terms of Service, Privacy Policy, and Community Guidelines.

1. Who We Are and Our Role

Social Gear, Inc. operates a self-service advertising platform. Depending on the activity, we act as a controller of personal information (for example, for our own account, billing, marketing, and platform-operation purposes) or as a processor / service provider on behalf of an advertiser or agency (for example, when processing campaign data on their documented instructions). Where we act as a processor, the applicable Data Processing Agreement governs that processing.

We source advertising demand into third-party inventory and technology, including the LYKSTAGE streaming platform (operated by LYK Inc.), Amazon advertising services, PubMatic, and, where offered, Google Display & Video 360. These providers are described in Section 9 and in our Subprocessor List.

2. Information We Collect

2.1 Information you provide

Account and registration details (name, business name, email, phone, username, credentials); billing and payment information; campaign information and creative assets; communications and support requests; marketing preferences; and employment-application information where you apply for a role.

2.2 Information collected automatically

Device and technical data (IP address, device identifiers, browser and operating-system information), usage and log data, and information collected through cookies and similar technologies (see our Cookie Policy).

2.3 Creator dataset (Creator Console)

Our Creator Console makes available a dataset of creators so that advertisers can identify and contact creators for brand promotion. This dataset includes information we have procured and information obtained from publicly available sources and third-party platform APIs, including the YouTube API Services (see Section 3). It may include creator names, handles, public profile and channel information, audience and engagement metrics, content categories, and contact routing through the platform.

2.4 Information from third parties

We may receive information from identity providers (where you sign in with a third-party account), business-data providers, advertising and analytics partners, and platform APIs, consistent with applicable law and those providers' terms.

3. YouTube API Services

Certain features of our Services, including creator discovery and enrichment, use the YouTube API Services. By using these features, you agree to be bound by the YouTube Terms of Service. Our access to and use of information obtained through the YouTube API Services adheres to the Google API Services User Data Policy, including its Limited Use requirements.

Information handled through the YouTube API Services is also subject to the Google Privacy Policy. Where applicable, an authorised creator may revoke our access to their data through the Google security-settings page. We use YouTube API data solely to [describe actual use], and we handle and retain such data only as permitted under the YouTube API Services Terms.

4. How We Use Information

We use personal information to: create and manage accounts; deliver, operate, and secure the Services; process payments; provide the Creator Console discovery and outreach features; deliver and measure advertising campaigns across programmatic, LYKSTAGE, and other inventory; personalise and improve the Services; communicate with you; conduct analytics and research (using aggregated or de-identified data where practical); prevent fraud and abuse; and comply with legal obligations.

5. Artificial Intelligence

We use artificial-intelligence technologies, including third-party AI providers, to deliver and improve features such as creator matching, campaign optimisation, and recommendations. Where personal data is processed by an AI provider on our behalf, that provider acts as our subprocessor under contractual data-protection terms and processes the data only to provide the feature. We do not permit our AI subprocessors to use your personal data to train their own general-purpose models except as expressly disclosed and permitted by law.

6. Legal Bases (where applicable)

Where required (for example, under the GDPR, UK GDPR, or India's DPDPA), we rely on one or more of: performance of a contract; our legitimate business interests (balanced against your rights); your consent (which you may withdraw); compliance with legal obligations; and protection of vital interests. Where we rely on consent for advertising or tracking, you may withdraw it as described in Sections 8 and 10.

7. How We Share Information

We share personal information with: service providers and subprocessors (Section 9); advertising and inventory partners as needed to deliver campaigns (including LYK Inc./LYKSTAGE, Amazon, PubMatic, and DV360); business partners where you participate in a campaign or collaboration; affiliates; legal and governmental authorities where required; and parties to a corporate transaction. We do not sell personal information for money; however, certain advertising-related sharing may be considered a "sale" or "share" under U.S. state laws — see Section 8.

8. Your U.S. State Privacy Choices (Sale/Share)

California and other U.S. state laws define "sale" and "sharing" broadly to include certain disclosures of personal information for cross-context behavioural advertising, even where no money is exchanged. Our use of programmatic advertising and advertising-technology partners may constitute "sharing" (and in some cases "sale") under these laws.

You have the right to opt out. Exercise it through our "Do Not Sell or Share My Personal Information" link at mysocialgear.com/opt-out. We honour the Global Privacy Control (GPC) browser signal as a valid opt-out. We do not knowingly sell or share the personal information of individuals under 16 without the authorisation required by law. Depending on your state, you may also have rights to access, correct, delete, and appeal, and to be free from discrimination for exercising these rights.

9. Third-Party Platforms and Subprocessors

Our Services operate with, and exchange data through, third-party advertising and technology platforms to deliver, measure, and optimise campaigns and features. Depending on the Services you use, these include: the LYKSTAGE streaming platform (LYK Inc.); Amazon advertising services; PubMatic; Google Display & Video 360 (where offered); AI processing providers (for example, OpenAI); and the YouTube API Services. Information may be shared with or received from these platforms as necessary to provide the relevant feature, subject to their terms and privacy policies. Our current providers are listed in our Subprocessor List.

10. Cookies, Tracking, and Interest-Based Advertising

We use cookies and similar technologies as described in our Cookie Policy. We and our advertising partners use cookies and identifiers to deliver interest-based advertising. You can opt out through the Digital Advertising Alliance (optout.aboutads.info), the Network Advertising Initiative (optout.networkadvertising.org), and, in the EU/UK, Your Online Choices (youronlinechoices.eu); on mobile, use your device's advertising-identifier controls. Opting out does not stop all advertising — only interest-based personalisation.

11. Data Retention

We retain personal information only as long as necessary for the purposes described here, to comply with legal, tax, and accounting obligations, resolve disputes, and enforce agreements. When no longer required, information is deleted, anonymised, or archived where legally permitted. YouTube API data is retained only as permitted under the YouTube API Services Terms.

12. International Transfers

As a global service, we may process information in countries other than where it was collected. Where required, we implement appropriate safeguards, including Standard Contractual Clauses, the UK International Data Transfer Addendum, adequacy mechanisms, or other lawful transfer mechanisms.

13. Your Privacy Rights

Subject to applicable law, you may have rights to access, correct, delete, port, restrict, or object to processing, to withdraw consent, to opt out of sale/sharing and interest-based advertising, and to lodge a complaint with a supervisory authority. To exercise these rights, contact us using Section 16. Creators listed in the Creator Console may request access to, correction of, or deletion of their information as described at mysocialgear.com/creator-rights.

14. Children's Privacy

You must meet the minimum age to use the Services in your jurisdiction. The Services are not directed to children under 13, and we do not knowingly collect their personal information. Where local law sets a higher age of digital consent, that higher age applies — for example, in India, where individuals under 18 are treated as children under the DPDPA, we require verifiable consent of a parent or lawful guardian; in the EEA, the applicable member-state age (13–16) applies. Features involving payments or contracts require users to be at least 18 (or the local age of majority).

15. Security

We maintain administrative, technical, and organisational safeguards designed to protect personal information, including encryption, access controls, monitoring, and incident-response procedures. No method of transmission or storage is completely secure.

17. Changes to This Notice

We may update this Privacy Notice periodically. Material changes will be communicated through appropriate channels, and the Effective Date will be updated. Where required by law, we will obtain consent before implementing material changes.
